略论教育法学学科性质

摘    要:作为一门新兴的学科,教育法学的地位、研究对象等问题在理论界有不同的观点。有的把它视为行政法学,有的把它归属于教育学的一个分支学科,还有的把它视为交叉性边缘学科等等,对教育法学如何定性不仅仅是一个学科归属问题,它框定了认识教育法学的本质属性、地位和体质等基本理论问题的视角范围。本分析了教育法学与相邻学科的关系,认为教育法学是一门独立的法学分支学科。

Abstract:The Science of Education Law is a new subject.There are different viewpoints about the position, research object of the subject. Someone think the science of Education Law belongs to the science of Administration Law, someone think it belongs to the Pedagogy, and others think it belongs to frontier branches of science and so on. The author thinks how to determine the nature of the subject will be decided how to know the essence, attribute, position and system of the subject.The author analyzed relation of the science of Education Law and other subjects concerned, and pointed out the science of Education Law is a independent sbuject of branch of law.
