| 摘 要： | 《馒头血案》是一部独立于电影《无极》的作品,其创作并非演绎创作,自然不存在侵犯修改权、保护作品完整权、改编权、汇编权的问题.利用电影《无极》的画面片断创作《馒头血案》,属于著作权法中的"引用",但这种"引用"超过了"适当"的限度,因而构成侵权.
