| 摘 要： | 道德法律化是在当前社会转型时期道德水平不容乐观的现实情况下提出的。正是道德具有向法律转化的可能性,这一主张才能在现实中得以实施。但道德向法律的转化过程绝不是任意的,是有条件的。如何把握法律化的道德是一个不容忽视的问题。

| Abstract: | In virtue of the present serious situation of the historic declination in morality during the period of social variation in China, correspondingly, the moral legalization be brought forward. Some scholars think that the moral legalization will abolish the morality. In fact, the allegation is based on the fact and theory, and because of the possibility of the moral legalization, the opinion can take into fact. However, moral legalization is not arbitrary, in the process of the moral legalization some questions should be take into account. And the sorts of morality to be legalized should be attached to importance. |
