高等学校教育中惩戒的研究

摘    要:随着中国民主法制建设日趋完善,教育法学的理论和实践的研究成为教育研究的重点,惩戒权是教育法学研究的热点。本文通过分析惩戒在高等学校教育中的价值及高等学校教育中惩戒的现状,探讨高等学校教育中过度惩戒中的救济问题及防止惩戒过度的几点思考,来自学校层面的过度惩戒可以通过申诉、行政诉讼获得权利救济;来自教师个体的过度惩戒可以通过民事诉讼等途径获得权利救济。

Abstract:With the improvement of democracy legal system construction in China,the study on the theory and practice of education law has became the stress of education research.The discipline right has been the focus of the former.This article analyzes the present conditions and the value of discipline in college education,inquires into the remedy right of excess discipline in college education and puts forward some reflections on avoiding excess discipline from college could obtain the right remedy through the appeal and the administrative proceedings,and the teachers' excess discipline could obtain it by means of civil action.
