| 摘 要： | 通过分析勾地制度的源起及引入到中国的发展历程,简要分析勾地制度的运作程序。在介绍勾地制度合法性的基础上,提出勾地制度是一种兼有民事法律和行政合同性质的勾地行为,并从合同法角度进行诠释。

| Abstract: | By analyzing the origins of Application List System for Land Auction to- gether with its access to the development process in China,the article takes up a brief analysis on operational procedures of Application List System for Land Auction. Meanwhile,on the basis of introducing the legitimacy of the System,the article pro- poses that the system represents the public land sales concerning both civil law and administrative contract nature,and offers further interpretations from the perspective of contract law. |
