| 摘 要： | 在我国,理论国际私法与实务国际私法存在一定的对抗或背离的倾向。理论国际私法偏爱于从国际主义出发,注重国际协调,遵循内外国法平等适用的理念,强调冲突规范的依职权强制适用性;实务国际私法偏爱于从国家主义出发,注重国家利益的维护,遵循内国法优位的理念,更愿意接受冲突规范的任意适用性。应考虑以我国涉外民商事审判实务之需建构我国国际私法理论之体。
