| 摘 要： | 国际法的人本化发展趋势是现代国际法发展的重要特征，在这一背景下，个人的价值及其地位在国际法制度体系内不断提升。但是，国际法的人本化趋势并没有使个人的权利和地位在现行国际法体系内获得无限拓展．在现行的以国家为主导的国际法体系内，个人仍没有取得能与国家抗衡的自主地位，其权利的实现的进程仍取决于国家的意愿。

| Abstract: | The trend toward humanism of international law is an important feature of contemporary international law. Under this background, the value of individuals is cherished and their status is upgraded. However, this phenomenon doesn＇t make the individual rights and status expand unlimitedly. It never changes the character of international law as the regime between states. Obviously, in the existing framework of international law, individuals do not have absolute autonomous status yet, the realization of their rights still depends on the States＂ intentions. |
