| 摘 要： | 从中国历史上内刑的废除之艰难和外国废除死刑之后的反复来看,废除死刑将更为艰难.尤其是,我国现行刑罚体系的不完善也证明了死刑不可轻言废除.目前,我们所能做的只有尽力对死刑加以完善,包括三方面内容:公开死刑执行人数,提高现行刑罚等级、严格死刑执行程序,限制法官的自由裁量权.

| Abstract: | Initiates from the Chinese civilization,the death penalty is closely linked with populace's life.The retribution idea has already integrated in populace's blood.The corporal punishment abolishes difficult and the foreign country after the Chinese history abolishes the death penalty to look repeatedly,will abolish the death penalty to be more difficult.In particular,our country present penalty system was imperfect had also proven the death penalty could not say lightly abolishes.At present,we can do only then consummate with every effort to the death penalty,including three aspect contents: the public death penalty carries out the population,l enhances the present penalty rank and strict death penalty executive routine,limits judge's freedom to decide after deliberation the power. |
