| 摘 要： | “运动式”行政执法是我国现行行政部门通行的执法方式,它能够集中力量在短时间内迅速打击各类违法犯罪行为、稳定社会秩序,但在运动式执法过程中,行政机关却往往忽视了程序,这就容易侵犯行政相对人的合法权益,而且也容易助长形式主义和随意性。因此,随着改革的深入与市场经济的发展,我国行政执法方式急需从运动式执法向制度性执法转变。

| Abstract: | The paper discusses the problems existing in the "campaign type" enforcement of administrative laws in China.Although this kind of enforcement,which is a common practice in administrative departments,can crack down criminals and stabilize the society quickly and forcefully,it often gives rise to ignorance of enforcing procedure and infringement upon people's legitimate rights and interests,which encourages formalism and randomness. Therefore,with the deepening of the reform and development of market economy,it is urgent to transform the way of enforcing administrative law in our country from the campaign type to institutional law enforcement. |
