| 摘 要： | 在我国，无论是学术界还是司法实践中，对侵权法上因果关系的认定一直存在较大的争议。通过普通法系近因理论和大陆法系相当因果关系理论兼收并蓄，探究以近因说中可预见性规则为主，以相当因果关系中的可能性（盖然性）规则为辅来认定因果关系。

| Abstract: | There has been a hot issue in our country on the confirmation of the causality of tort law both in academia and judicial practice. This paper tries to confirm the causality, by combining the predictable rules of the proximate cause of the Anglo - American Legal System and the probable rules of the relative causality theory of the Continental Legal System. |
