| 摘 要： | 《工伤保险条例》关于工伤认定申请主体的规定存在诸多的缺陷,在实践中造成了诸多的问题,因而必须对其进行改革,要建立用人单位强制申报制度;对享有申请工伤认定申请权的主体的申请顺序作出界定;直系亲属的范围作出一个界定。

| Abstract: | There is some imperfectness about the application for determination of work-related injures in Work-related Injure Insurance Regulations,which brings many problems in the process of practice.This paper argues that Work-related Injure Insurance Regulations should be improved including：establishing a mandatory reporting system of work unit,defining application order for the person who has right to apply for the determination for work-related injures;defining the scale of direct-related family members. |
