| 摘 要： | 关联合同制度起源于德国法，对于信贷买卖中消费者权益的保护具有十分重要的意义。我国消费信贷起步较晚，现如今仅仅在商品房买卖领域通过司法解释确立了关联合同制度，其内容集中规定在了司法解释的第23、24、25条中。然而我国并没有将关联合同制度完全引入，仅仅是确立了其中的抗辩直索权。与此同时，已经建立起来的也仅仅是一个基本的关联合同制度的雏形，相关制度还有待进一步完善。

| Abstract: | The system of relational contract which originates from German Law is important to protect the consumers＆#39;rights in business activities .The consumption credit starts late in our country ,and the relational contract system has only been established in the domain of commercial housing business by the judicial expla-nations ：the provisions 23 ,24 and 25 .However ,this system has not been introduced completely except the defense right of direct claim ,and the established system is only a fundamental prototype ,w hich still has a large room to be improved . |
