| 摘 要： | 尽管各国因社会制度、历史习惯、经济发展状况等存在着重大差别，但各国侵权法皆以过错责任为原则，表明了过错责任原则在社会生活中的极端重要性。过错责任原则通过惩戒作用，促使行为人行为时尽合理的注意义务，做一个谨慎、勤勉、细心的人．以避免损害的发生。
