| 摘 要： | 制定一部《校园安全法》是推动我国学校安全管理制度化的关键。制定这样一部法律,必须在理论上对立法的目标、功能、模式、原则和制度框架具有清晰的认识。学校安全立法的目标和功能是为学校应急管理机制的有效、有序、有力运行提供支撑和保障。在立法模式上,应当选择制定一部适用于各级各类学校、用于调整学校突发事件应对全过程的、公私合体的统一立法。其立法原则包括实质法治原则、权力优位原则、比例原则、权责能统一原则等,而立法的制度框架应主要围绕学校应急管理中的关键机制展开,兼及学校应急管理体制和学校应急预案制度。
