| 摘 要： | 信息化的发展一方面为社会公众实现信息共享创造了条件，另一方面又引发了一系列社会问题，其中最突出的问题是知识产权保护和信息资源共享之间的关系处理问题。知识产权代表的是个人利益，信息资源共享是社会公共利益，在推进信息化过程中，信息拥有与使用中的矛盾冲突日益突出。文章在论证知识产权保护与信息资源共享合理性的基础上，进一步探讨了知识产权保护与信息资源共享之间的关系，提出相关平衡机制构建的建议。

| Abstract: | The development of IT application has provided the public with the conditions of sharing information resources, on the other hand, it has also triggered a series of social problems. One of the most significant problems is how to correctly handle the relationship between intellectual property protection and sharing of information resources. Intellectual property represents the personal interests, while sharing information resources represents the public interests. The conflict between information owners and users has become increasingly obvious during the process of IT application. This article demonstrates the reasons for intellectual property protection and the sharing of information resources, discusses the relationship between the intellectual property and the sharing of information resources; and proposes some suggestions about the construction of balancing mechanism between them. |
