| 摘 要： | 近年来我国仲裁法学界和仲裁实践中对仲裁第三人制度存在的价值与途径争议颇多,文章围绕各学派争议及仲裁实践的探索进行了评析,在肯定目前研究成果的基础上指出其不足,并竭力纠正理论界与实践界对仲裁第三人的主体定位偏差。

| Abstract: | In recent yares there were quite many controversies over the value and methods of the third party in arbitratiion to exist in China's arbitration field.The paper gives comments on the controversies and practical research,points out the defects with the errors in positioning the third party by arbitratiion theoreticians and practitioners. |
