| 摘 要： | 基本法是在总结《魏玛宪法》失败的教训和第三帝国的反面经验的基础上发展起来的。在张扬人权保障的同时,它还在条款中设置了自卫型民主的装置,高扬自由民主的价值。联邦宪法法院是基本法专职的守护者,在判决中它发展了一系列为司法实务所接受的理论,其中有的超越了国家利益,具有国际意义。一体化中出现的欧洲法院和欧洲人权法院则从另一个角度守护着基本法。但是,无论如何,正如卢梭所言,最重要的法律是铭刻在公民的内心里的。
