| 摘 要： | 孟德斯鸠“分权学说”的精神实质就是要求国家的立法权、行政权、司法权实行分立，中国要构建现代法治国家应借鉴其法理，树立“法律至上”理念，确保监督主体的独立性、权威性，理顺党政职能，加强权力对权力的制约。 |
