| 摘 要： | 我国常有婚内侵权行为的受害人无法得到应有救济的案例,无救济即无权利,这与我国法治精神相悖离的。随着我国经济的日益发展、夫妻个人财产权的确立以及公民维权意识的增强,我国立法建立婚内侵权赔偿制度是必要的,亦是切实可行的。同时,应建立相关配套设施,如配偶权、非常财产制等。

| Abstract: | As an old saying goes,＂no remedy,no right＂.However,lots of victims of matrimonial tort have never got the proper remedy in our country,so it doesn＇t obey the spirit of rule of law.With the development of China＇s economy,the citizens＇ consciousness strengthens gradually.What＇s more,the equal economic status for both husbands and wives becomes the principle initiated in the law.That is to say,it is necessary to build up the system of the damage compensation in matrimonial tort.At the same time,related facilities should be built up,such as the right of spouse,special property system of husband and wife and so on. |
