| 摘 要： | "国家尊重和保障人权"是我国人权发展史上的一大亮点,它从根本法的角度制约公权对人权的侵害。而超期羁押问题,就是政府部门及其官员越出法定权限和程序行使权力,对公民人权的严重侵犯。为了预防和纠正超期羁押,尊重和保障人权必须转变执法观念,树立人权保障意识;完善立法,建立人权保障的长效机制;严格执法,强化监督。

| Abstract: | "Thecountry respects and ensures human rights" is a great light spot on the development history of human rights of our country,it restricts the common infringement of human rights in terms of fundamental law.And extend detention question,it is government department and his officer that produce legal authority and procedure exercise power,serious infringement of citizen's human rights.In order to prevent and correct extending detention,respect and ensure human rights to change ideas of enforcing the law,establish hmuan rihgts and ensure consciousness;Perfect the legislation,set up the long result mechanism that human rights ensures;Enforce the law strictly,strengthen and supervise. |
