| 摘 要： | 电子商务作为一种全新的商务形式,近几年在我国,乃至全世界得到了长足的发展,随之产生的纠纷也日益增多。基于网络的特性,传统的司法管辖体系在电子商务争议案件中面临着前所未有的困境。文章结合网络自身特征,试图从分析传统司法管辖权在网络环境中遭遇的尴尬入手,参考美国等的立法与实践经验,形成电子商务争议案件中司法管辖权协调之方法。

| Abstract: | As a bran-new commercial form,electronic commerce has got a quite great development in our country even all over the world recently,along with the increasingly manifold of the dissensions.Base on the characteristic of network,traditional jurisdiction system are facing with difficulties in the Internet law cases.In this text,combining with the characteristic of network,the author tries to start by analyzing the traditional jurisdiction's embarrassments encountered in the network's environment,to form the harmonic measures of jurisdiction in Electronic Commerce disputed cases,referring to the legislation and practical experience of America and other countries. |
