| 摘 要： | 现行保险法对于保险人说明范围规定的模糊性,导致理论上和实践中对于保险人的说明范围认识不一。从英美保险法关于保险人说明范围的发展历程可知,确定保险人说明范围的实质标准在于,保险条款内容是否对投保人或被保险人的权益有重要影响。同时,利益平衡原则和保单通俗化进程应为限定保险人说明范围的内外双重因素。

| Abstract: | The confusion of the regulations about scope that the insurer should disclose contributes to the differences both in practice and theory.From the development of insurance law in foreign countries on the same problem,we can confirm that the essential standard is whether the rules have significance impact on the insured.Moreover,the balance of interests and generality of policy should be considered to restrict the scope that the insurer should disclose. |
