| 摘 要： | 比较唐宋两代录囚制度和赦免制度 ,可知 :唐太宗贞观六年的录囚尚存理狱之意 ,还是不同于宋代类似纵囚的录囚的 ,太宗此举也不是为邀名 ;欧阳修《纵囚论》一文只是欲借太宗录囚之题来反对宋代的大赦而已

| Abstract: | This paper holds the view that the trial system ,which was practised in the sixth year of Zhen Guan period in Tang Dynasty ,is different from that of Song Dynasty,as seen through comparison of the trial and record system and remitting system between Tang and Song Dynasties.Ou Yangxu expresses ,in his book On Remission,his disagreement with the remitting system of the Song Dynasty by remarking on emperor Tang Tai Zhong's system. |
