| 摘 要： | 我国《合同法》引入了具有典型英美法传统的预期违约制度。预期违约的类型,一直是我国法学理论界的重要讨论话题。文章提出预期违约宜分为明示拒绝履行、默示拒绝履行和预期不能履行三种具体形态,并重点论证了关于默示拒绝履行构成要件和预期不能履行构成要件的观点。

| Abstract: | The new Contract Law of China introduces the anticipatory contract-breaching system(ACBS) which is typical of the traditional Anglo-French-American law system.The sort of Anticipatory breach is always important research subject.The author thinks that Anticipatory breach should be classified into explicit repudiation,implicit repudiation and prospective inability to perform.Each type of anticipatory breach has specific component parts. |
