| 摘 要： | 物权法定原则在成本控制和交易自由的双重压力下,已到了不得不检讨的时候.但重新认识物权法定原则,还需要重视物权法定本身的包容性.首先,维护物权法定关乎物权结构原则的稳定性；其次,物权体系并非一成不变,财产权系统允许续造,形成了新的法定物权；另外,就我国的实际情况而言,这一原则写入物权法有其价值考量,而在物权类型法定的同时也要注重其与公示制度的配合.

| Abstract: | Numerus Clausus Principle, under double stage where self-criticism is a must. However, the re pressure from the cost control and free trade, has come to the thinking of the Principle involves the due attention to capacity of the Numerus Clausus itself. First, stability of the principle is concerned in maintaining the Numerus Clausus; Sec- ond, the system is not unalterable. In addition, there is some value putting the principle in the property law in practi- cal situation in China. And the coordination with the publicity system should be noticed. |
