| 摘 要： | 给予外来务工人员社会保障权关系到我国社会的可持续发展。但外来务工人员社会保障权在法律制定、框架设立、司法监督、实施效果等方面却不尽如人意，主要受到主客观因素的制约。完善外来务工人员社会保障权法律体系，需要从加快社会保障法律制度建设，制定相对独立的外来务工人员社会保障制度，建立外来务工人员社会救济法律制度等方面着手。
