| 摘 要： | 本文辩证地分析了银行监管法律制度的价值取向对银行监管法制建设的导向作用,结合中国银行监管法律制度形成和发展的实际情况,具体探讨安全优先的价值取向与效率优先的价值取向对银行监管法律制度的现实意义,并在此基础上就如何正确把握安全与效率的对立统一关系,如何面对不断变化的国内、国际经济形势及时调整银行监管法律制度的价值取向,如何在调整银行监管法律制度价值取向的过程中处理好法律的稳定性与灵活性的辩证关系等方面提出相应的看法。

The Orientation of Value on the Legal Supervision over Banking |

| Abstract: | No matter what kind of legal supervision it would be, security oriented or efficiency oriented, it could be the most effective one only when it is helpful in safeguarding the banking against all risks, while at the same time achieving the biggest benefits. On the basis of an analysis of the present reform and development of the banking in China, the essay first investigates the potential obstacles and their countermeasures in the set up of an ideal legal supervision framework. Then the essay explores the possibility of establishing a feasible legal supervision over the banking with Chinese characteristics. |
