摘    要:基本案情 费列罗有限公司是一家世界知名的食品生产商,其生产的“金莎”巧克力在广大消费者当中享有较高声誉。2001年12月3日,费列罗公司在其所在国意大利首次提出了将单粒“金莎’巧克力的外观(简称申请商标)注册为立体商标的申请,该申请于2002年5月23日被意大利商标管理机关核准并给予该三维形状以立体商标的法律保护。2002年9月28日,费列罗公司根据《商标国际注册马德里协定》的相关规定,通过世界知识产权组织国际局提出了对於该商标在中国进行领土延伸保护的申请,该商标指定使用的商品为第30类的面包、糕点、糖果、食品上的巧克力覆盖层等多种食品。

Probe into the Standards for Registration and Protection of Three-dimensional Marks: Discussion starting from the Ferrero Case

Abstract:The Case in brief
The plaintiff, the Ferrero S manufacturer, and the Ferrero P. A, is a world-known food Rocher chocolate produced thereby has a relatively high reputation among consumers. On 3 December 2001, the plaintiff first filed, in its home country Italy, an application for registration of the design of a piece of Ferrero Rocher chocolate as a three-dimensional mark (hereinafter referred to as the mark in suit), and the application was approved, on 23 May 2002, by the Italian relevant trademark administrative authority, with the three-dimensional shape accorded the legal protection as a threedimensional mark. On 28 September 2002, the plaintiff filed, in accordance with the Madrid Agreement Concerning the international Registration of Marks, an application for extended protection of said mark within the territory of China through the International Bureau of the World Intellectual Property Office (WlPO). Said mark was to be used in respect of the goods of chocolate cover on multiple foodstuffs, such as bread, cakes, sweets, cookies, and other eatables in class 30.
