| 摘 要： | 随着犯罪形势的不断变化,确立于70年代的我国刑罚体系已逐渐不符合社会发展的趋势,在司法实践中凸显其不足。为建设和谐、法治的社会,预防和减少犯罪发生,就必须重新构建我国的刑罚体系。在目前刑罚体系相对合理性的基础上,借鉴西方刑罚体系的优点,考虑我国的特殊国情,在科学合理的刑罚价值理念的指导下,选择适当的刑罚种类,确保刑种彼此间的可分配性和可执行性,以此重新构建科学合理的刑罚体系。

| Abstract: | With the development of the variety of the criminal position, the penalty system in our country established in 1970s is not in accord with the current of social development, and is showing the shortage in judicial practice. To construct the harmonious and law governed society, to prevent and lessen the crime, we must afresh the building of the criminal system of our country. Based on the rationality of the current criminal system, drawing on the merit of the criminal system in the west, from the situation of our country, and under the direction of the rational idea of the criminal worth, we should choose the proper criminal variety, and insure the allotment and implement between the criminal varieties. Based on this, we can rebuild the rational criminal system. |
