| 摘 要： | 抵押权存续期间按照是否由当事人约定，可以分为抵押权法定存续期间与抵押权约定存续期间。前者是由法律直接规定的，后者是当事人由在法律规定的范围内约定的。当事人有约定抵押权存续期间的自由。法律对当事人所享有的约定抵押权存续期间的自由应从期间起算点、长短、登记等方面加以规制。

| Abstract: | As to whether the parties of the right to mortgage have the freedom to make agreement, the duration of the right to mortgage is divided into contractual time limitation of right to mortgage and legal time limitation of right to mortgage. The former is directly regulated by law;the latter is contracted by the party in the legal scope. The party has the freedom of contractual time limitation of right to mortgage. According to law, the parties may prescribe the starting point, length and register of contractual time limitation for the right to mortgage. |
