| 摘 要： | 李大钊的法制思想与中国近代的法制变革息息相关。李大钊的现代法制观念突出表现为争取法律主权、民族独立和平等。其法制思想主要包括以下方面：第一，专制时代尚人治，立宪时代重法治。第二，宪政制度是国家最重要的法律制度，保障人民自由权利是宪政的基本内容。第三，发展社会主义的民主政治是中国民主法制建设的方向。

| Abstract: | Li Dazhao's legal thoughts is closely connected with the legal transformation in modern China. Li Dazhao's modern legal concept is particularly represented by obtaining law rights,national independance and equality.His legal thoughts includes as follows:First,in the age of momarchy,talents based rule is emphasized and in the age of constitutional system,law based rule is stressed.Second,constitutional system is the most important law system of nation,whose basic content is to protect people's right of freedom.Third,to develop socialist democratic politics is the direction of China's democratic legal construction. |
