| 摘 要： | 合法性要求被统治者的首肯、社会价值观念的认同,它与法律性质、有效性、公民的权利与义务密切相关。对于任何政治统治而言,合法性都是有效执政的基本资源。合法性危机意味着失去被统治者的忠诚,它将带来国家和社会基本结构的变化,尽管其表现形式纷繁复杂,但在其背后有着诸多深层次的诱发原因。21世纪的中国共产党正面临着调整与重建政治合法性基础的重大任务,而完善宪政则是摆脱合法性危机的基本出路。

| Abstract: | The legitimacy requests the first agreement of the ruled,the approval of social valuable idea,and it is related to the legal nature,the validity and the citizen's right and voluntary.For any political rule,the legitimacy is basic resource for the effective rule.The crisis of legitimacy means to the losses of the loyalty of the ruled,and it will bring the changes to the nation and the social basic structure.Although its manifestation is complex,there are many deeply reasons to induce it,and it brings multiple challenge to the reforming China.In the 21st century,Communist Party of China is facing the significant duty of adjusting and the reconstructing the foundation of the legitimacy,then consummating the constitutionalism is the basic outlet to get rid of the crisis of legitimacy. |
