| 摘 要： | 社会经济迅速发展,古玩交易日益成为一种新兴的投资方式。当前的古董交易市场上,古玩珍品和各种仿品鱼龙混杂,立法空白更加剧了古玩市场的虚假繁荣。纠纷面前,古玩交易行业惯例的如何适用就成为当务之急,文章通过对行业惯例的解构,分析其存在的欺诈性因素以及进行规制的法理基础,旨在推动行业惯例的正确适用。

| Abstract: | With rapid development social economy,antique trade increasingly becomes a new mode of investment.In current antique markets,antique treasures and all sorts of counterfeits mix up.Moreover,loss of legislation intensifies false prosperity of antique market.It paraphrases the usage of the particular trade,analyzes some existing fraudulent factors and governs corresponding legal bases to the proper application of the usage of the particular trade. |
