| 摘 要： | 行政奖励作为一种新型有效的行政管理手段，在实现行政目标、提高行政相对人积极性、创造性等方面具有重要的法律功能，其突出的主要功能有价值功能、激励功能、资源配置功能和社会导向功能等。全面系统的研究和揭示行政奖励的基本法律功能，对于正确认识行政奖励的正当性和现实性，构建法治理念下的行政奖励制度具有十分重要的意义。

| Abstract: | As a new means of effective administration, administrative encouragement has an important legal function to achieve administrative goals, enhancing administrative counterpart enthusiasm and creativity, etc. Its specific functions include value function, encouragement function, resource allocation function and social-oriented function. Comprehensively and systematically researching and revealing the basic legal functions of administrative encouragement is of great significance for correctly understanding the legitimacy of administrative encouragement and construction of the rule of law under the concept of Administrative eneouragement system. |
