| 摘 要： | 在当下中国,对于法官应发挥的作用,并未形成清晰的定位。由于我们忽视了对法官活动空间的界定,才出现了法官社会角色及其作用的多元。正当法律程序构成了法官活动的空间,使法官的作用得以充分发挥。以正当法律程序为视角,法官所起到的作用不应涵盖过多,而只应当包括指挥程序和裁判纠纷,即通过指挥程序的进行,对纠纷做出具有法律权威的裁判。

| Abstract: | There is no clear conclusion about the function of judges in China today. The role of judges now means so many things just because we ignore defining the judges＇ working space. Due process of law provides that space. Under the perspective of due process of law, we can say that judges have only two functions：leading the procedure and solving disputes, which means giving an authoritative judgement after leading a due procedure. |
