| 摘 要： | 行政附带民事诉讼作为一项实践催生、立法重视的新兴程序制度,学界对其争论比较激烈,甚至不乏相互对立的观点。近年来,随着公民诉权意识的觉醒,行政诉讼数量的不断增多,研究行政附带民事诉讼在当今中国社会状况下有着极其重要的意义。
