| 摘 要： | 实现"天子所与天下公共"的法治,也是司马迁的法治理想。司马迁用他实录的历史告诉我们:实现这种理想的特定历史条件是"兼听"的明君和"守法不失大理"的执法者;君权至高无上的君主专制制度是不能容忍"天子所与天下公共"的法治;即或出现所理想的法治局面也只能是昙花一现而已。 |
