| 摘 要： | 民办高等教育是伴随着高等教育投资主体多元化而兴起的,已经成为我国高等教育的重要组成部分。但随着民办高等教育的发展,诸多法律困惑亦难以回避地凸现出来,如：民办高校的“法人”地位、民办高校的产权界定、民办高校的学生管理等问题,已经出现并制约了民办高等教育的发展。分析了产生上述问题的原因,提出了破解民办高校办学中法律困境的对策。
