| 摘 要： | 法律与宗教、道德等作为社会控制的重要手段,在历史上经历了由混合到分离的嬗变过程。在西汉中期的法制转型中,随着儒家学说定于一尊,被囊括在儒家思想之中的宗法性宗教对汉代法制产生了直接影响,赋予法律以神秘的力量,使汉代法制具有宗教性特征。
