| 摘 要： | 汉初统治者采用黄老学说作为治国之圭皋。集中体现黄老思想的《黄帝四经》是研究黄老学说的重要典籍,其中的《经法》篇对于法制的具体阐述集中体现了黄老学说的法律思想。其余各篇中也有法律思想的具体表述。《黄帝四经》的法律思想同儒家法律传统之间存在诸多契合点,但也存在明显的差异性。在后世的发展中,黄老思想已融入以儒家为主流的帝制政治法律思想体系之中,并成为后世一些具体法律制度的理论来源。

| Abstract: | The Huang Lao Doctrine was taken by the rulers of the early Han dynasty as the criterion of ruling the country. The Four Classics of Yellow Emperor,representative of Huang Lao＇s thought,is one of the most important works for studying the Huang Lao Doctrine. The specific elaboration of the legal system by one of the four classics,the Law,embodies the doctrine of Huang Lao＇s legal thought which is also elaborated by the other three classics. There are,as well as significant differences,many similarities between the legal thought of the Four Classics of Yellow Emperor and the legal tradition of Confucius. In the development of the later generations, Huang Lao＇s thought was integrated into the imperial political and legal thought system mainstreamed with Confucian ideology and became the theoretical basis of some legal systems. |
