| 摘 要： | 现行刑事立法在确定中小学生刑事责任上过于笼统,将中小学生犯罪提交审判率过高,打击面太宽,对过多的中小学生判处刑罚将影响他们的健康成长,社会影响并不好。应当对现行的未成年人犯罪法律进行相应的改革。

| Abstract: | The criminal legislation of current laws is far too general on ascertaining the criminal liability of the minors.The rate of putting the minors' crimes in trials is increasingly high and the rage of punishment is far too wide,thus would effect badly on the minors' growing up and do no good to the society.There should be a reformation on the current law of minors' crimes. |
