| 摘 要： | 侦查活动必须依法进行，但作为侦查谋略而被广泛使用的“诱导性侦查”却很难在合法与非法之间找到一条明显的界线。而该侦查方法在英美法系和大陆法系的不同理论和价值取向也在一定程序上影响了我们在对待该问题的视野和判断，因此有必要在我国刑事理论中为之找到合适的定位。特别是在人权入宪和刑诉法即将修改的背景下，重新审视这个问题也具现实意义。

| Abstract: | The investigation must be taken according to law. The derivational investigation used broadly as strategy was legal or illegal, it＇s still a problem. There are different theories and value about the derivational investigation in AngloAmerican legal system and continental legal system, which impact on our opinions to judge. Therefore, it is necessary to make clear for the derivational investigation in our criminal theories, and it is practical significance to rethink of this issue, especially in the background that human right will be written in constitution and the criminal procedure law will be revised. |
