| 摘 要： | 孟德斯鸠在《论法的精神》中曾言:“司法权在某种意义上可以说是不存在的”。孟氏所言之此种司法权,虽亦存在于宪法政制的构想之中,但实质上乃是一种原生形态的司法权,即相当于“市民性的司法权”,显然有别于“政治性的司法权”,尚不具有现代宪法政制所赋予的本质属性,故成为政治上的“不存在”。以美国为代表的司法审查制度的确立使这种司法权进一步演化为一种“政治存在”。这是司法参与权力制衡以及人权保障的需要,也是对民主不信任的结果。

| Abstract: | Montesquieu said:"In some sense judicial power isn't being".Judicial power separated originally from legislation and administration is essentially a kind of civil power of judiciary,which consists of the essence of judicial power.To civil power of judiciary,politics and power is far from its center.Civil power of judiciary is not only no mind but no compelling,which dedicate its thought to the task of protecting law's norms.When Montesquieu said that judicial power was to a certain extent non-being,his meaning was that judicial power, the third power,had no influence on legislation and did not intervene in administration,so for the two original powers of legislation and administration,judicial power did not matter.Judicial review,however,makes judicial power come into being in the field of politics and power. |
