| 摘 要： | 行政自由裁量权具有四方面的要素,它在法治社会有其存在的合理性和必要性,其本身亦蕴含着公平正义性,在实践中,由于诸多原因的存在导致行政自由裁量权的被滥用,为了实现个案的公平正义,应从立法限制、司法审查和制度建设等方面着手对行政自由裁量权予以限制。
