| 摘 要： | 仲裁协议是仲裁制度的基石,有效的仲裁协议引起仲裁程序的发生,利于仲裁裁决的承认和执行。仲裁协议形式要件规定的国际立法发展以实现当事人仲裁意愿为出发点,对我国仲裁立法具有借鉴作用。
