| 摘 要： | 公民权利与政府权力的关系问题是宪政民主的核心问题。西方思想史上的自由主义宪政论者把二者的对立绝对化,由此陷入二元对立的思维范式。超越二元对立的前提在于,运用人类政治智慧对二者的关系合理定位。在利益多元化的当今社会,通过合作治理,有可能走出公民权利与政府权力二元对立的困境。

| Abstract: | The relationship between civil right and government power is a key issue of constitutional democracy.Liberalist constitutional democrats in the history of Western ideology took the two as absolutely antagonistic,and thus found themselves lost in a thinking pattern of binary opposition.To overcome this barrier of binary opposition,we must utilize our political wisdom as men to properly locate the relationship between civil right and government power.In the present-day society in which interests have become more and more pluralistic,we can hope to get out of the dilemma of binary opposition between civil right and government power through cooperative administration. |
