| 摘 要： | 刑事附带民事诉讼是否应当包括精神损害赔偿,历来就存有争议。由于我国相关法律不承认刑事附带精神损害赔偿,致使我国附带民事诉讼制度存在诸多缺陷,严重影响了被害人权益的保障,也不利于树立司法权威。确立刑事附带精神损害赔偿制度,其基本价值取向在于尊重和保障人权,维护被害人的合法权益。在我国确立刑事附带精神损害赔偿制度,有其理论上和实践上的依据。应严格按照相关的民事法律规范确定附带精神损害赔偿的请求权主体、赔偿范围等问题。

| Abstract: | Whether criminal lawsuit affiliated with civil lawsuit should cover the compensation for spiritual damage has always been controversial.Our national law does not recognize the compensation for spiritual damage to be affiliated to criminal lawsuit.As a result,there are many flaws in our affiliation system of civil lawsuit,which not only have seriously affected the victims'interests,but also are harmful to the establishment of the judicatory authority.The basic value orientation of establishing criminal lawsuit affiliated with compensation for spiritual damage lies in respecting and protecting human rights and the victims's lawful rights.It is both practically and theoretically based to establishing criminal lawsuit affiliated with compensation for spiritual damage.It is neccesary to,according to the corresponding laws,determine the subjects of claim,the range of the compensation in establishing the system. |
