| 摘 要： | 目的/意义] 本文从实践及政策上，梳理了我国大数据交易中产权问题的管理进展，总结其中存在的问题，以期为我国大数据交易实践提供参考借鉴。方法/过程] 在实践上，从合法授权、权属流转、交易监管3个方面调查了我国典型大数据交易平台的产权管理现状；政策上，归纳了目前我国大数据发展政策中对数据交易产权的规定，并从政策工具视角进行分析。结果/结论] 研究发现，我国目前对大数据交易中的产权问题重视程度不足，大数据交易产权政策结构失衡，对实践的约束力也有待加强，需要加强产权的激励和资源配置作用，拉动大数据交易市场发展，同时国家层面出台相应法律政策予以规范交易行为。

| Abstract: | Purpose/Significance] This paper reviewed the management progress of property rights in big data transactions in China from the perspective of practice and policy in order to provide the reference for the practice of big data transaction in China.Method/Process] From the view of practice,this paper investigated the status of property rights management of typical big data transaction platforms in China from three aspects:legal authorization,ownership transfer,and transaction supervision.From the policy point of view,this paper summarized the current regulations on data transaction property rights in China's big data development policy and analyzes them from the perspective of policy tools.Result/Conclusion] It found that the current property rights policy tools of big data transaction were mainly concentrated on the environmental and demand side.It was concluded that the property rights in big data transactions were not paid enough attention and the policy structure of big data transactions is unbalanced.It is necessary to strengthen the incentive and resource allocation roles of property rights to promote the development of big data transaction market.At the same time,the country had to legislate corresponding policies to regulate transaction behavior. |
