摘    要:对"一房二卖"中恶意次买受人的利益是否一概不受保护的问题,理论上和司法实践中存在着诸多模糊之处和争议点。根据恶意次买受人的主观恶意的程度,将其区分为恶意串通、单纯知情及应知但因重大过失却不知,并主张予以区分对待。对于单纯知情或应知但因重大过失却不知的恶意次买受人的利益,应当受法律保护,其与出卖人签订的合同依法应属有效;在其办理房屋登记后,其亦可确定地取得房屋所有权。而出卖人与次买受人恶意串通的行为,则为法律明文禁止,不应受到保护,惟可能在特定情形下发生两者分担损失的问题。

Abstract:In theory and in practice,there are many vague and controversial points about whether to protect the interest of the malicious inferior vendee in the dual transaction of the same house.The article divides malicious inferior vendee into three categories,such as the one maliciously colluded,the one only informed,the one should be aware but not aware because of gross negligence.Therefore,the authorconsiders different malicious inferiorvendee should be regulated by different rules in different circumstances.With the development of market economy,the concept of free competition is accepted by people,the sellers in the same house sold twice often adopt the rule of efficient breach to maximize their own interest.So the legislature and the courts can't completely deny the inferior vendees'right just because they knew the house has been sold.By different measures of the legal analysis,and concluded that,forthe only informed orshould have known but do not know because of gross negligence of malicious sub-venders,they should be protected by law.The contract with the vender in accordance with law should be valid.After applying for house registration,hey can own the house.For the maliciously colluded sub-buyer,they can't be protected by the law,except in the special circumstances.
