| 摘 要： | “同光之治”是清朝封建统治的尾声，“同光司法”的司法运作所凸现出的诸多弊病折射出封建司法的效力低下、审判不公，审判体系混乱恰恰是这些缺陷的重要体现。在审判“四川东乡抗粮案”过程中，“同光司法”所存在的以上诸多问题成了制约案件顺利进展的制约因素。由于该时期司法体系存在着自身难以解决的矛盾，因此，传统封建司法体制必然被更为先进的近现代司法体制所代替。

| Abstract: | The government of tongguang periods is the ultimate period of the Qing dynasty. This article try to analyse the different traits and problems of the judicature of TongGuang periods by the case of objecting food taxes in DongXiang county,there are a lot of problems in the case,which inclue the poor efficiency,wrfair and confusion of judicature of the TongGuang periods,through this analysis to explain the necessary historical result of the judicature of TongGuang periods and prove it must be eliminated by the history development . |
